Mission Cityzen Terms and Conditions

The following terms and conditions (the “Mission: Cityzen T&Cs”) shall apply to any individual wishing to submit video footage (your “Video”) and a CV (together your “Application”) as part of the Mission: Cityzen competition.   

By submitting your Application to Manchester City Football Club (the “Club”) you agree to be bound by these terms and conditions.  If you do not agree to be bound by all of these terms and conditions, do not submit your Application to the Club.

1.     Campaign Outline

1.1.   Your Video must be no longer than 30 (thirty) seconds and your Application must be submitted before 12pm GMT on Thursday 27th March 2014.

1.2.   Your Application will be reviewed by a panel of judges selected by the Club, such panel to include senior personnel of the Club’s HR and marketing departments and/or personnel from appropriate agencies (the “Panel”). The Panel will judge your Application and produce a list of shortlisted supporters (the “Shortlisted Supporters”) using two main criteria: (i) how big a fan are you?; and (ii) how well suited are you to the position of Cityzens Executive (or such other title as the Club may choose, acting in its absolute discretion). The decision of the Panel will be final and no correspondence will be entered into.  The Club reserves the right to choose no Application and/or employ none of the Shortlisted Supporters.

1.3.   The Shortlisted Supporters will be announced on or around Monday 31th March 2014. Shortlisted Supporters will be asked to attend an event at the Etihad Stadium or such other venue as the Club, acting in its absolute discretion, may decide (the “Next Round”).  In the event that you are invited to attend the Next Round, you hereby irrevocably grant all consents necessary for the Club to film and record such Next Round.

1.4.   Further details and terms and conditions will be communicated to the Shortlisted Supporters prior to the Next Round. Acceptance of such terms and conditions shall be a condition of involvement in the Next Round of the competition.

1.5.   The final decision as to who is appointed to the position of Cityzens Executive (or such other title as the Club may choose acting in its absolute discretion) shall be decided either by the Club in absolute discretion or by popular vote via a social media platform.

2.     Application Conditions

2.1.   Applications must be submitted online following the instructions outlined on the relevant page of the Club’s website at www.mcfc.co.uk/missioncityzen.

2.2.   To apply, you must have the right to live and work in the UK, Channel Islands, Isle of Man or Republic of Ireland and be able to demonstrate that you have this right on request by the Club at any time and you agree to notify the Club immediately of any change in your immigration status.

2.3.   No Video should feature any other individual or refer to any other individual by name unless such individual has expressly consented to featuring or being named in your Video for the purposes of this competition and the licence granted at clause 3.2 below.

2.4.   You hereby warrant that your Video and all information which you submit will not infringe the intellectual property, privacy or any other rights of any third party and will not contain any defamatory or offensive material.

2.5.   You agree to indemnify the Club against any and all claims, costs, charges and expenses and any other liability of any nature whatsoever, (including without limitation, legal fees and any sums paid on the advice of Counsel) resulting from breach by you of any of these Mission:Cityzen T&Cs, including the warranties and/or undertakings contained herein.

2.6.   The Club reserves the right to disqualify you if you have supplied untruthful, inaccurate or misleading personal details and/or information, have failed to abide by the rules communicated by the Club in connection with the competition and/or are in breach of these Mission:Cityzen T&Cs.

2.7.   You must disclose to the Club details of any criminal convictions and/or unspent convictions other than driving offences which have not resulted in a ban or more serious sentence. You shall notify the Club immediately if there are any criminal charges brought against you or if any information you provide in your application becomes inaccurate between now and the end of your involvement in the Mission:Cityzen competition.

3.     Intellectual Property

3.1.   The Club does not claim any rights of ownership in your Video. As such, you retain ownership of your Video and, subject to any licence granted to the Club, you will also have the right to use your Video however you choose. You are responsible for obtaining all the relevant permissions and licences required to enable you to grant the licence set out in clause 3.2 below, including but not limited to, music used and permission to film at a location. 

3.2.   By submitting your Video to the Club you hereby grant to the Club, and parties authorised by the Club, an irrevocable, perpetual, non-exclusive, royalty free, transferrable licence (with the right to sub-licence) to use your Video (or part thereof) worldwide and in any and all media, for any purpose without payment, further liability or acknowledgement to you. The Club shall be entitled to edit, copy, add to, take from, adapt or translate your Video as it sees fit (acting in its absolute discretion).

3.3.   You hereby irrevocably and unconditionally waive any so-called "moral rights of authors" in the Video and such rights under section 77 and section 80 of the Copyright Designs and Patents Act 1988, or similar rights arising under the laws of any jurisdiction, as you now have or hereafter acquire in relation to the Video.

4.     Marketing

4.1.   You acknowledge that the Club may use your Video for marketing purposes, for example, your Video may feature on the big screens at match day events. You grant to the Club the right to issue and use publicity concerning your Video and any programme in which it may be included and for such purpose to use and reproduce your name and photograph and recordings and/or copies of any description of your Video. 

4.2.   The Club does not accept any responsibility for any damage, loss, injury or disappointment suffered by you through the Club’s use of your Video.

4.3.   In the event that you are invited to attend the Next Round, you hereby irrevocably grant all consents necessary for the Club to use the recordings referred to in clause 1.3 above featuring your image and/or voice in connection with the Mission: Cityzen competition and to exploit the same in all media in any territory for marketing or promotional purposes (whether or not you are ultimately successful in the competition or not) without further payment or acknowledgement to you.

5.     Data  Protection

5.1.   When submitting your Application, you acknowledge that your name, phone number, address, e-mail address will have been made available to the Club (the “Personal Data”). All Personal Data will be held and used by the Club in accordance with the Club’s privacy policy (which can be found at http://www.mcfc.co.uk/Common/Privacy) and the Data Protection Act 1998.

6.     General

6.1.   It shall remain the responsibility of each individual submitting an Application to ensure that the Club has up-to-date contact details for that individual at all times. The Club accepts no responsibility for non-receipt of notices or any consequences resulting from such non-receipt where this is as a result of incorrect or out of date details being supplied.

6.2.   This agreement may be freely assigned or licensed by the Club. 

6.3.   These terms and conditions are governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England.
